Housing and property legislation — damp, mould and remediation compliance

Housing legislation across the four nations of the UK operates under distinct frameworks. Awaab Law (England) imposes statutory timescales on social landlords. The Renting Homes (Wales) Act 2016 applies a fitness for habitation standard across all Welsh rented housing. Scotland operates under the Repairing Standard and the Housing (Scotland) Act 2006 with enforcement through the First-tier Tribunal. Northern Ireland uses the fitness standard under the Housing (Northern Ireland) Order 1981 with enforcement through district councils and the NIHE. For maintenance contractors and remediation firms, the practical equipment obligations are consistent across all four nations -- COSHH governs how mould remediation must be carried out regardless of which housing legislation applies.

Awaab Law -- England, social housing

Part of the Social Housing (Regulation) Act 2023. Imposes legally enforceable timescales on registered social landlords for investigating and remediating damp and mould. Emergency hazards within 24 hours. Standard cases investigated within 14 days, written remediation plan within a further 14 days. Phase 2 confirmed November 2026 extends the framework.

Renting Homes (Wales) Act 2016 -- Wales, all rented housing

In force from 1 December 2022. Applies a fitness for human habitation standard to all rented properties in Wales -- social and private. Damp and mould is an explicit ground for unfitness throughout the occupation contract.

Scotland -- Repairing Standard and Housing (Scotland) Act 2006

Scotland operates under the Repairing Standard introduced by the Housing (Scotland) Act 2006. Enforcement is through the First-tier Tribunal for Scotland (Housing and Property Chamber), not local authority environmental health. Social housing is governed by the Scottish Housing Quality Standard (SHQS). Scotland does not have an equivalent to Awaab Law but the Repairing Standard creates similar obligations for private landlords and RSLs. SEPA regulates wash-down water under CAR 2011, not the Environment Agency.

Northern Ireland -- Housing (Northern Ireland) Order 1981 and Private Tenancies Act 2022

Northern Ireland operates under the fitness standard in the Housing (Northern Ireland) Order 1981. Enforcement through district councils and the Northern Ireland Housing Executive. All private landlords must be registered under the Landlord Registration Scheme. The Private Tenancies Act (Northern Ireland) 2022 strengthened minimum standards including damp and excess cold requirements. NIEA regulates water discharge in Northern Ireland.

Pre-2000 housing stock -- asbestos considerations

Contractors carrying out mould remediation in properties built before 2000 must be aware that these buildings frequently contain asbestos-containing materials in textured coatings, floor tiles, ceiling tiles, pipe lagging and Artex finishes. Where ACMs are present or suspected, H-Class extraction is mandatory under CAR 2012.

The COSHH connection

All four national frameworks create an obligation to remediate mould. COSHH 2002 determines how that remediation must be carried out wherever in the UK it takes place. Mould spores are a biological hazard under COSHH. M-Class extraction is the minimum; H-Class is required where contamination is severe or the risk assessment identifies higher exposure risk.
